TTAB Posts October 2020 Hearing Schedule

The Trademark Trial and Appeal Board (Tee-Tee-Ā-Bee) has scheduled six (6) oral hearings for the month of October 2020. The hearings will be held via video. Briefs and other papers for each case may be found at TTABVUE via the links provided.


October 14, 2020 - 11 AM: In re Simoniz USA, Inc., Serial No. 87865135 [Section 2(d) refusal of SIMONIZ CERAMICSHIELD for "Paint sealant for exterior surfaces of vehicle" in view of the registered mark PLATINUM CERAMIC SHIELD for "“Clear coating protectant containing
ceramic nanoparticles for use on vehicles" [CERAMIC disclaimed].

October 20, 2020 - 11 AM: In re Carolyn Anderson Beautiful, LLC, Serial No. 87851445 [Section 2(d) refusal of the mark BEAUTIFUL (stylized) for various hair care products, in view of the registered mark BEAUTIFUL (standard characters) for "perfume, cologne, body creme, body lotion, body powder, perfumed soap"].


 October 21, 2020 - 11 AM: In re Hydro-Gear Limited Partnership, Serial No. 87641657 [Refusal to register ZT-1800 for "Land vehicle parts, namely, transaxles" on the ground that the proposed mark will be perceived merely as a model designation and therefore it fails to function as a trademark].


October 22, 2020 - 2 PM: Combe Incorporated v. Marke Enterprises, LLC, Opposition Nos. 91214779 and 91215509 [Opposition to registration of VAGISERT, in standard character and design form, for "Vaginal antifungal preparations," in view of the registered marks VAGISIL and VAGISTAT for feminine-health products, including vaginal medicated creams]. 

October 27, 2020 - 11 AM: Philanthropist.com, Inc.v. The General Conference Corporation of Seventh-day Adventists, Cancellation Nos. 92065178 and 92065255 [Petition for cancellation of a registration for the mark ADVENTIST for religious publications, employee benefit and insurance programs, film production and distribution, health care services, educational services, and religious observances and missionary services, on the ground of genericness].


October 29, 2020 - 1 PM: In re Cigna Intellectual Property, Inc., Serial No. 86842483 [Refusal to register LEVEL FUNDING for "Administration of employee benefits plans, namely, administration of employer-based self-funded or partially-funded group health plans, with stop loss insurance, featuring predictable monthly fees and costs" on the grounds of genericness and, alternatively, mere descriptiveness and lack of acquired distinctiveness].
