USPTO Moves to Dismiss Its 11th Circuit HOUNDSTOOTH MAFIA Appeal

On April 29, 2016, the USPTO filed a motion (here) to voluntarily dismiss its appeal from the decision of the U.S. District Court for the Northern District of Alabama in Board of Trustees of the University of Alabama v. Houndstooth Mafia Enterprises, LLC, Case No. Case No.: 7:13-CV-1736-RDP (N.D. Alabama February 23, 2016). In that ruling [TTABlogged here], the district court ordered the TTAB to vacate its decision in the HOUNDSTOOTH MAFIA case after the Board declined to do so on the request of the parties. The TTAB vacated its original 2013 decision in March 3, 2016.

TTABlog comment: Several dozen law professors wrote to the Department of Justice, asking the Department to pursue this appeal due to their concern over this pay-for-vacatur approach to the law.
