TTAB Posts August 2015 Hearing Schedule
The Trademark Trial and Appeal Board has scheduled three (3) oral hearings for the month of August, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. The hearing schedule and other details regarding attendance may be found at the TTAB website (lower right-hand corner). August 4, 2015 - 10 AM: In re Heirloom LA, LLC, Serial No. 85552395 [Refusal to register LASAGNA CUPCAKES for "individual-sized portions of lasagna, namely, individual-sized portions of lasagna with meat and vegetable fillings" [LASAGNA disclaimed] on the ground that the applied-for mark is generic, or in the alternative, merely descriptive under Section 2(e)(1)].
August 11, 2015 - 2 PM: In re Santa Crux Toacco Co., Inc., Serial No. 77129912 [Section 2(e)(3) refusal to register GRAN HABANO for "cigars made from cuban seed tobacco" [HABANO disclaimed], on the ground that them mark is primarily geographically deceptively misdescriptive].
August 26, 2015 - 2 PM: In re Midwestern Pet Foods, Inc., Serial No.85501982 [Refusal based on failure to disclaim CHICKEN CASSEROLE in the mark CHIP'S CHICKEN CASSEROLE for "pet food"].

I think LASAGNA CUPCAKES and GRAND HABANO are doomed. On the pet food one, CHICKEN CASSEROLE should be disclaimed but it would seem to me that CHIPS'S is distinctive.
"LASAGNA CUPCAKES" sounds disgusting - and not generic. Even if made in a cupcake pan, I don't think the mark as a whole is generic or that "cupcakes" is descriptive here. Should be disclaimer of lasagna only.
