TTAB Posts December 2014 Hearing Schedule
The Trademark Trial and Appeal Board has scheduled four (IV) oral hearings for the month of December, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. December 11, 2014 - 11 AM: In re Rich Marks, LLC, Serial Nos. 85789873, 85789870, and 85784407 [Refusal to register REDNECK RIVIERA and REDNECK RIVIERA FEST for entertainment services and hotel and restaurant services [FEST disclaimed] on the alternative grounds that the marks are either primarily geographically descriptive of the services under Section 2(e)(2) or primarily geographically deceptively misdescriptive under Section 2(e)(3)].
December 16, 2014 - 11 AM: In re E.R. Shaw, Inc., Serial No. 85797528 [Refusal to register the three-dimensional configuration of external helical fluting (shown below) for "rifle barrels; rifles," on the grounds of functionality under Section 2(e)(5) and failure to comply with the examining attorney's requirement for information under Rule 2.61(b)].
December 17, 2014 - 2 PM: Baccarat v. Northeast Distributors Inc., Opposition No. 91194574 [Three-pronged opposition to registration of the mark BACCARA in the stylized form shown first below, for "bottled water," in view of the registered mark BACCARAT in the stylized form shown second below, for glassware, including bottles, on the grounds of false association under Section 2(a), likelihood of confusion under Section 2(d), and likelihood of dilution under Section 43(c)].
December 17, 2014 - 3 PM: Publix Asset Management Company v.
