TTAB Posts January 2014 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled 7 (seven) oral hearings for the month of January, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. January 7, 2014 - 2 PM: In re Peak Financial Partners, Inc., Serial No. 85414941 [Section 2(d) refusal to register the mark PEAK & Design, shown below, for certain financial and real estate services, in view of the registered marks PEAK FINANCIAL MANAGEMENT, INC. for certain financial services; PEAK PROPERTY MANAGEMENT for certain real estate services; PEAK PROPERTY MANAGEMENT & Design for certain real estate services; and PEAK REAL ESTATE ADVISORS for real estate brokerage services.].


January 9, 2014 - 2 PM: In re Dana Limited, Serial No. 85447797 [Refusal to register the mark shown below for axles for vehicles," in which mark the "44 shown in brokes [sic] lines represents that any number with at least two digits may be used," on the ground that applicant seeks to register multiple marks in violation of Sections 1 and 45 of the Trademark Act].


January 15, 2014 - 10 AM: Experient, LLC v. Experient Inc., Opposition No. 91190253 [Section 2(d) opposition to registration of the mark EXPERIENT for meeting, convention, exhibition, seminar, event, tradeshow, and conference services, in view of Opposer's alleged prior use of the identical mark EXPERIENT for event marketing and planning services].


January 15, 2014 - 2 PM: Citigroup Inc. v. Citiair, LLC, Opposition No. 91201920 [Opposition to registration of CITIAIR & Design for "travel booking agencies" on the grounds of likelihood of confusion and likelihood of dilution of the registered and allegedly famous CITI-formative marks for banking, credit care, and related services].


January 16, 2014 - 2 PM: In re Lancome Parfums et Beaute & Cie, Serial No. 85081226 [Section 2(d) refusal to register the mark Ô D'AZUR & Design for deodorants, lotions, gels, sprays, mousses and balms for hair styling and hair care, and other products in class 3, in view of the registered mark D’AZUR hair spray, hand lotion, and personal deodorant].


January 23, 2014 - 2 PM: In re Aristocrat Technologies Australia Pty Ltd, Serial No. 77753502 [Section 2(d) refusal to register BUFFALO for "gaming machines, namely, devices which accept a wager," in view of the registered mark BUFFALO BUCKS for "gaming machines and operating software that runs thereon"].


January 28, 2014 - 11 AM: In re Amazing Mazes, Serial No. 85122528 [Refusal to register the mark 4D for "entertainment services in the nature of an amusement park attraction, namely, a themed area featuring mirror labyrinths with rotating mirrors therein," on the ground of mere descriptiveness or, alternatively, deceptive misdescriptiveness, under Section 2(e)(1)].
