The Trademark Trial and Appeal Board has scheduled eight (8) oral hearings for the month of June, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. June 11, 2013 - 2 PM: Chatam International Incorporated v. Chase Marketing International, LLC, Opposition No. 91189955 [Opposition to registration of AWESOME and AWESOME VODKA for distilled spirits, in view of Opposer's alleged common law rights in the mark AWESOME for a pre-packaged vodka cocktail].

June 12, 2013 - 2 PM: Mylan Inc. v. Beaufort County Allergy, Opposition No. 91195868 [Section 2(d) opposition to EPI-KEY for "medical devices for treating patients with allergies who are at risk of experiencing anaphylaxis," in view of the registered mark EPIPEN for hypodermic injectors and injectable pharmaceuticals intended to treat severe allergic reactions].

June 18, 2013 - 2 PM: In re Sutro Product Development, Inc., Serial No. 77418246 [Refusal to register a proposed sound mark comprising "a series of three, regularly spaced, repeated clicks, wherein the clicks resemble the sound of a small metal object striking another metal object" for “eye glasses; optical glasses; sun glasses," on the ground that the purported mark comprises a feature of the identified goods that serves a utilitarian purpose].

June 19, 2013 - 10 AM: In re Visionstar, Inc., Serial No. 85319715 [Section 2(d) refusal of MAXGAIN for "natural supplements for mail enhancement" in light of the registered mark MAXIMUM GAIN for food, herbal, and other supplements].

June 25, 2013 - 11 AM: In re Healthy Children Project, Inc. DBA Academy of Lactation Policy and Practice, Serial No. 77938432 [Refusal to register CLC as a certification mark for lactation consulting services on the ground that the mark, as used on the specimen of record, designates a title or degree and does not function as a certification mark].

June 25, 2013 - 2 PM: In re Universal Scientific Industrial Co., Ltd., Serial Nos. 85111035 and 85076805 [Section 2(d) refusal to register HSIP in stylized form, in view of the registered mark HSIPA, both for various telephone and computer goods].

June 26, 2013 - 2 PM: Facebook, Inc. v. Think Computer Corporation, Opposition No. 91198355 [Opposition to registration of FACEMAIL for email and instant messaging services on the grounds of likelihood of confusion with, and likelihood of dilution of, the registered mark FACEBOOK for online messaging services].

June 27, 2013 - 10 AM: In re BabyCakes NYC, Inc., Serial No. 85214746 [Section 2(d) refusal to register BABYCAKES NYC & Design for "retail bakery shops" in view of the registered mark BABYCAKES for "staple foods, namely, doughnuts and bakery goods"].
