"REDSKINS" Disparagement Case Headlines TTAB's March 2013 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled four (4) oral hearings for the month of March, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. March 7, 2013 - 2 PM: Blackhorse v. Pro Football, Inc., Cancellation No. 92046185 [This proceeding, the latest chapter in the long-running battle over the REDSKINS trademark registrations, began in 2006 when a new petition for cancellation was filed by six Native American petitioners seeking to knock out the registrations on the ground of Section 2(a) disparagement. These new petitioners had “only just recently reached the age of majority,” and therefore were not affected by the ruling of the courts that laches barred the claims of the prior petitioners]. March 12, 2013 - 11 AM: Intellect Technical Solutions, Inc. v. Soni, Cancellation No. 92050920 [Petition for cancellation of a registration for ENTELLECT for employment and other counseling services on the grounds of likelihood of confusion with the previously-used mark INTELLECT, non-use, and abandonment].


March 12, 2013 - 2 PM:: Swatch AG v. M.Z. Berger & Co., Inc., Opposition No. 91187092 [Opposition to registration of iWatch, in standard character form, for "Cases for clock and watch-making; Cases for watches and clocks; Clock and watch hands; Dials for clock-and-watch-making; Diving watches; Jewelry watches; Parts for watches; Pocket watches; Stop watches; Watch bands; Watch bands and straps; Watch boxes; Watch bracelets; Watch cases; Watch chains; Watch clasps; Watch crowns; Watch faces; Watch fobs; Watch parts; Watch straps made of metal or leather or plastic; Watches; Watches containing a game function; Wrist watches; Alarm clocks; Clock dials; Clocks; Pendulum clocks; Small clocks; Table clocks; Wall clocks," on the grounds of likelihood of confusion with Opposer's registered mark SWATCH, and lack of bona fide intent].


March 21, 2013 - 2 PM: Gado S.r.L. v. Jay-Y Enterprise Co., Inc., Cancellation No. 92047433 [Section 2(d) petition for cancellation of two registrations for the mark DG in stylized form (shown below) for sunglasses, optical frames, and reading glasses, on the ground of likelihood of confusion with the registered marks DOLCE & GABBANA, DB DOLCE & GABBANA, and D & G, and the common law mark DG, for clothing and accessories].
