The Trademark Trial and Appeal Board has scheduled five (5) oral hearings for the month of January, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. January 10, 2013 - 2 PM: In re Pan American Grain MFG. CO., Inc., Serial No. 85035510 [Refusal to register ARROZ VALENCIA G & Design for "enriched rice; rice; rice flour" [ARROZ disclaimed], on the ground that the mark is deceptive under Section 2(a) because Applicant's rice does not include rice of the "Valencia" type].

January 22, 2013 - 2 PM: In re ALM Media Properties, LLC, Serial No. 77953193 [Section 2(d) refusal of IP INSIDER for  magazines, newsletters, on-line publications and Internet information in the field of law" [IP disclaimed], likely to cause confusion with the registered mark TRADEMARK INSIDER for a "periodical in the field of intellectual property"].

January 23, 2013 - 2 PM:: In re Image Industries, Inc., Serial No. 77058258 [Section 2(d) refusal of BLUEARC & Design for "electric stud welding machines; Electric arc stud welding machines; Stud welding tools, namely, stud welding chucks, grips, legs, feet, spark shields, and bowl feeders" and for "Power supplies, namely, drawn arc and cpacitor discharge stud welding power supplies, transformer and rectifier stud welding power supplies, and inverter stud welding power supplies; Electric ground cables for stud welding power supplies; Extension cables for stud welding tools," in view of the registered mark BLUE ARC for "Water-based electrolyte coolants for electro-chemical machining operations  Electro-chemical discharge machine tools for metalworking"].

January 24, 2013 - 2 PM: Central Garden & Pet Company v. Doskocil Manufacturing Company, Inc., Opposition No. 91188816 [Section 2(d) opposition to DOGZILLA  & Design for "dog toys" in view of the registered mark ZILLA for  "vivariums, terrariums, and aquariums for small animals; accessories for vivariums, terrariums, and aquariums, namely, tanks and artificial landscapes, stands, canopies, covers, hoods, air stones, aquarium fish nets" and for "pet food; pet treats." Applicant Doskocil raised the affirmative defense of laches and counterclaimed to cancel Central's pleaded registration on the basis of an allegedly illegal assignment of the underlying Section 1(b) application, in violation of Section 10].

January 31, 2013 - 10 AM: In re Antwan Patton, Serial No. 77248382 [Section 2(d) refusal of BIG BOI for various clothing items, in view of the registered mark BIG BOY GEAR for "clothing, namely, jackets, jerseys, tshirts, pants, caps, hats" [GEAR disclaimed].
