TTAB Posts July 2012 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled seven (7) oral hearings for the month of July, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. July 11, 2012 - 10 AM: In re Frederick D. Graves, Serial No. 77761950 [Section 2(e)(1) mere descriptiveness refusal of AMERICAN JUSTICE FOUNDATION for "promoting the interests of the legal and justice system" and for "providing a website featuring educational information in the fields of the legal and justice system"].


July 11, 2012 - 11 AM: In re Shawn M. Lynch, Serial No. 77892923 [Section 2(e)(2) refusal of INTERIORUSA.NET for "On-line retail store services featuring a wide variety of consumer goods of others," on the ground that the mark is primarily merely geographically descriptive, and for failure to provide a specimen showing use in commerce].


July 17, 2012 - 10 AM: Warner Bros. Entertainment Inc. v. Akke Wagenaar, Opposition No. 91186293 [Opposition to registration of ANIMATRIX for "Entertainment services, namely, the production of computer graphics animations, conducting entertainment exhibitions in the field of computer graphics animations, and providing information via a global computer network about computer graphics animations," on the grounds of non-use, fraud, and abandonment, and because the applied-for mark is the title of a single work, and therefore unregistrable].


July 17, 2012 - 2 PM: Sunbeam Products, Inc. v. OSRAM GmbH, Opposition No. 91171206 [Opposition to OSTAR for "light emitting diodes; light emitting diode displays and display circuit modules; and components of the aforementioned goods" on the grounds of likelihood of confusion with, and dilution of, the registered mark OSTER for a wide variety of goods, including electric hair clippers, toasters, heat massage machines and food mixers].


July 18, 2012 - 10 AM: In re Geller, Serial No. 77940879 [Section 2(a) refusal to register the mark STOP THE ISLAMISATION OF AMERICA for "providing information regarding understanding and preventing terrorism," on the ground of disparagement].


July 18, 2012 - 11 AM: In re Power Distribution, Inc., Serial No. 77825939 [Section 2(d) refusal of POWERWAVE BUS SYSTEM [BUS SYSTEM disclaimed] for "structured electrical busses comprising electrical power connectors, electrical power distribution units, and electric power supplies for use with electric power equipment, not for use with radio frequency power amplifiers, not for use with audio frequency power amplifiers, and not for use with power supplies for arc welders," on the ground of likely confusion with the registered marks POWERWAVE and POWERWAVE TECHNOLOGIES (TECHNOLOGIES disclaimed) for "converters" and "electrical power distribution units"].


July 19, 2012 - 11 AM: In re Midmark Corporation, Serial No. 77730355 [Section 2(e)(4) surname refusal of RITTER and refusal of Section 2(f) claim of acquired distinctiveness, for "Oil-less air compressors; lubricated air compressors, dental ultrasonic cleaners, namely, electrical ultrasonic cleaning units for cleaning dental equipment" and for "Dental chairs, dental stools, instrument delivery systems comprised of air and water delivery tubes and controls, operating lights for medical use only, oral surgery chairs, surgery lights for medical use only, examination floor lights for medical use only, dental operatory casework, namely, cabinets, dental furniture, dental instrument processing centers, namely instrument cleaners and associated cabinets, and dental sterilizers"].
