TTAB Posts May 2012 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled eight (8) oral hearings for the month of May, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. May 3, 2012 - 11 AM: In re InterDesign, Inc., Serial No. 77906060 [Refusal to register FRIDGE BINZ! on the Supplemental Register for "plastic storage containers for domestic use; plastic storage containers for use within refrigerators and freezers," on the ground of genericness].


May 3, 2012 - 2 PM: In re InterDesign, Inc. , Serial No. 77954696 [Section 2(a) refusal of SWISS+TECH for expandable and compact multi-function hand tools and electronic devices, on the ground of geographical deceptiveness].


May 8, 2012 - 10 AM: United States Postal Service v. Rpost International Limited., Opposition No. 91158431 [Consolidated proceeding challenging a registration for the mark (R)EGISTERED E-MAIL and applications for (R)EGISTERED RECEIPT and (R)ETURN RECEIPT for "delivery of electronic messages to a designated recipient on a basis equivalent to registered receipt mail," on the grounds of false connection or association under Section 2(a), mere descriptiveness under Section 2(e)(1), and likelihood of confusion with Plaintiff's common law mark REGISTERED MAIL under Section 2(d)].


May 8, 2012 - 2 PM: In re IO Data Centers LLC, Serial No. 77902194 [Refusal to register I/O ANYWHERE for "high density enclosures for computer servers and computer equipment" based on Applicant's failure to disclaim "I/O"]


May 9, 2012 - 2 PM: In re Guitar Straps Online, LLC, Serial No. 85047191 [Refusal to register the amended mark GOT STRAPS? on the ground that it is a material alteration of the original mark GOT STRAPS, for "bumper stickers" and "online retail store services featuring straps for musical instruments and accessories for musical
instruments."].

May 16, 2012 - 2 PM: Universal Furniture International, Inc. v. Welcome Industrial Corp., Opposition No. 91180838 [Opposition to UNIVERSAL HOME FASHIONS for furniture and home furnishings, on the ground of likely confusion with the registered mark UNIVERSAL "furniture," and on the ground on non-use as to some of Applicant's goods].


May 17, 2012 - 2 PM: Sunbeam Products, Inc. v. OSRAM GmbH, Opposition No. 91171206 [Opposition to OSTAR for "light emitting diodes; light emitting diode displays and display circuit modules; and components of the aforementioned goods" on the grounds of likelihood of confusion with, and dilution of, the registered mark OSTER for a wide variety of goods, including electric hair clippers, toasters, heat massage machines and food mixers].


May 23, 2012 - 2 PM: In re NRG Systems, Inc., Serial No. 85001796 [Section 2(d) refusal to register WINDLINX for computer services that provide web-based system and online portal for customers to manage their wind measurement equipment and communications accounts, in view of the registered mark WINDLINK, for "power, data and telecommunication cables for equipping wind turbines"].
