The Trademark Trial and Appeal Board has scheduled ten (10) hearings for the month of May, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. May 4, 2010 - 10 AM: In re CEMCO, Inc., Serial No. 77432339 [Refusal to register KOOLER KIOSK for "Water cooler attachment for storing, holding and displaying articles" on the alternative grounds of mere descriptiveness or deceptive misdescriptiveness under Section 2(e)(1)].


May 6, 2010 - 10 AM: In re Florida State University Credit Union , Serial No. 77415033 [Section 2(e)(1) mere descriptiveness refusal to register COLLEGIATE COMMUNITY FINANCIAL for "credit union services"].


May 11, 2010 - 2 PM: In re DAP Brands Company , Serial No. 77116207 [Refusal to register the design mark shown below for "adhesives for household purposes" on the ground that the design is a mere background carrier for the text on Applicant's specimen packaging and fails to function as a mark under Sections 1, 2, and 45, and on the ground that Applicant failed to clarify the description of the mark as required by the Examining Attorney].


May 12, 2010 - 2 PM: In re Himalaya Holdings Ltd. , Serial No. 77117183 [Section 2(d) refusal to register the mark SOLIGA FOREST HONEY for honey [FOREST HONEY disclaimed] in view of the registered mark FOREST HONEY & Design for honey].

May 18, 2010 - 10 AM: In re Qliktech International AB, Serial No. 79054312 [Section 2(d) refusal to register the design mark shown on the left in view of the design mark shown on the right, each for certain computer software and services].


May 19, 2010 - 2 PM: Long & Foster Companies, Inc. v. LFC Corporate Services, Inc., Opposition No. 91181109 [Section 2(d) opposition to LFC, LFC.COM, and LFC ONLINE for various real estate services, in view of several LF marks for real estate services].


May 25, 2010 - 2 PM: In re DG Fastchannel, Inc. , Serial No. 77136602 [Section 2(d) refusal of HD NOW for "Broadcasting services, namely, transmission of video advertising media and metadata via proprietary media management systems" [HD disclaimed], in view of the stylized mark HD NOW shown below, registered for "radio broadcasting services of digital signals" [HD disclaimed]].


May 26, 2010 - 2 PM: In re Viccino's Pizza Restaurants, Inc., Serial No. 77472394 [Section 2(d) refusal of VICCINO'S & Design for "delivery of food by restaurants" and "carry-out restaurants" in view of the registered mark IL VICINO for "restaurants"].
