TTAB Posts April 2010 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled five (5) hearings for the month of April, as listed below. Except for April 9th, the hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. April 1, 2010 - 2 PM: In re Becton, Dickinson & Company, Serial No. 77254637 [Refusal to register the product design shown below, comprising a three-dimensional configuration of a closure for medical collection tubes, for "closures for medical collection tubes" on the ground of functionality under Section 2(e)(5), or alternatively failure to function as a trademark].


April 6, 2010 - 10 AM: In re Sofrane, Serial No. 77384952 [Section 2(d) refusal to register the mark RENDEZ-VOUS BY PAUL & JOE SISTER for various clothing items in view of the registered mark RENDEZVOUS for foundation garments].


April 7, 2010 - 11 AM: In re RealKidz, Inc., Serial Nos. 77398503 and 77398544 [Section 2(d) refusal to register the two marks shown immediately below, for "clothing, namely skirts, pants, tops, dresses and everyday wear, namely denim jeans and sweatsuits," on the ground of likelihood of confusion with the registered mark FOR REAL KIDS for "bras, panties, tops, camisoles, shorts, sleepshirts, pajamas, gowns, robes, slippers, leggings, slips, chemises, underwear, tank tops, pantaloons, lingerie"].


April 9, 2010 - 3:15 PM, Boston University School of Law: Factory Five Racing, Inc. v. Carroll Shelby and Carroll Hall Shelby Trust, Opposition No 91150346[Opposition to registration of the product configuration mark shown below, for automobiles, on the grounds of genericness, abandonment, fraud, failure to function as a mark, and collateral estoppel].


April 20, 2010 - 2 PM: Vaad L'Harotzas Sichos, Inc. v. Kehot Publication Society, a division of Merkos L'Inyonei Chinuch, Inc., Opposition No. 91156051 [Dispute between two factions of the Lubavitch Chassidic community over registrability of the emblem shown below, for books, magazines, charts, maps, and photographs on a variety of aspects of Jewish life].
