TTAB Posts June 2009 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled eight hearings for the month of June, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. June 3, 2009 - 11 AM: In re Hyundai Motor America, Serial No. 78889340 [Section 2(d) refusal to register the mark ECHELON for "automobiles" in view of the identical mark registered for "automotive tires"].


June 11, 2009 - 2 PM: General Cable Technologies Corporation v. National Rural Electric Cooperative Association, Opposition No. 91165554 [Section 2(d) opposition to registration of the design mark shown below left for "promoting the interests of electric cooperatives by promulgating standards for uniform data formatting for facilitating the transfer of data between software applications," on the ground of likelihood of confusion with the registered design mark shown below right for wires, cables, and related products and services].



June 16, 2009 - 2 PM: Stoncor Group, Inc. v. Stonel Inc., Opposition No. 91177161 [Section 2(d) opposition to registration of the mark STONEL & Design for "Bricks; Concrete building materials namely, thin face brick on prefabricated panels," based upon an alleged family of "STON"-formative marks for flooring, coating, sealing and bonding products].


June 17, 2009 - 10 AM: Janice Cahajla v. Tail-Waggers of Hilton Head, Inc., Opposition No. 91177475 [Section 2(d) opposition to registration of the mark TAIL-WAGGERS GOURMET PET BAKERY & BOUTIQUE & Design for "retail gourmet pet food bakery and pet store" [GOURMET PET BAKERY & BOUTIQUE disclaimed] on the ground of likely confusion with the registered mark WAGTAILS for animal treats, scrap books, and pet beds].


June 18, 2009 - 2 PM: In re Centennial Communications Corp., Serial No. 76283603 [Two refusals to register NAP OF THE CARIBBEAN, first as being merely descriptive of "telecommunication services, namely, providing central connection points for telecommunication network carriers," and second on the ground of likely confusion with the mark NAP OF THE AMERICAS for various telecommunications services].


June 23, 2009 - 2 PM: Sportslife Enterprises Inc. v. Sportslife Camps, Inc., Opposition No. 91178951 [Section 2(d) opposition to registration of SportsLife Camps, Inc. for "religious-themed children's camps including sports and arts-related activities and religious experiences," in light of the registered marks SportsLife and SportsLife Enterprises & Design for 'wholesale distributorships featuring a variety of goods and apparel for retail to schools, teams, leagues and individuals"].


June 25, 2009 - 2 PM: Otto International, Inc. v. Otto Kern GmbH, Opposition No. 91170126 [Section 2(d) opposition to registration of the mark OTTO KERN & Design for leather goods and clothing, on the ground of confusing similarity with the registered marks OTTO in standard character and design form for handbags and clothing].


June 30, 2009 - 2 PM: In re PE Corporation (NY), Serial No. 78097617 [Section 2(d) refusal to register DIAGNOSTIC CONSTELLATION for diagnostic preparations for scientific, research or forensics use; and clinical medical and diagnostic reagents [DIAGNOSTIC disclaimed], on the ground of likely confusion with the registered mark CONSTELLATION for "medical apparatus, namely medical catheters for diagnostic and/or therapeutic uses"].
