TTAB Posts February 2009 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled seven (7) hearings for the month of February, as listed below. The hearings will be held in the East Wing of the Madison Building. February 3, 2009 - 11 AM: Regions Financial Corporation v. Regional Acceptance Corporation, Oppositions Nos. 91155299 and 91155302 [Section 2(d) oppositions to the mark REGIONAL in standard character and design form, for "financial services, namely, consumer and installment loans," based on Opposer's registered mark REGIONS for banking services.]


February 4, 2009 - 2 PM: Arturo Santana Gallego v. Santana's Grill, Inc., Cancellations Nos. 92043152, 92043160, and 92043175 [An intra-family dispute concerning three registrations for marks containing the word SANTANA'S for restaurant services.]


February 5, 2009 - 2 PM: In re Gratnell's Limited, Serial No. 78450327 [Refusal to register the product configuration mark shown below for storage trays, on the grounds of functionality under Section 2(e)(5), or alternatively on the grounds of lack of acquired distinctiveness and failure to function as a trademark.]


February 10, 2009 - 11 AM: In re Mi Pueblo San Jose, Inc., Serial No. 76679535 [Section 2(d) refusal of the mark shown below for retail grocery stores, in light of the registered mark MI PUEBLO for sauces and salsa.]


February 11, 2009 - 11 AM: In re Valuty, Inc., Serial No. 78934912 [Section 2(d) refusal of BIONIC AIR for "air purifier and ionizer," in view of the registered mark BIONICS for inter alia, “household air cleaners” and “ozone sanitizers for air.”]


February 25, 2009 - 2 PM: In re Ravensburger Aktiengesellschaft, Serial Nos. 77073391 and 77076651 [Section 2(d) refusals to register the marks shown below for, inter alia, artists' materials and toy painting playsets, in view of the registered mark THE ORIGINAL PAINT BY NUMBER for "drawing and painting kits consisting primarily of art prints with designs, paint brushes, liquid paint felt tip marking and coloring applicators, and paints."]


February 26, 2009 - 2 PM: In re Kathy Sayah, Serial No. 76486273 [Refusal to register the design shown below for "advertising agency namely, promoting the services of the travel, entertainment, and restaurant industry through the distribution of printed promotional materials, rendering sales promotion advice, and dissemination of advertising matter” and for "printing services," on the ground that the design is not being used by Applicant as a service mark.]
