TTAB Posts April 2008 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled four hearings for the month of April, as listed below. The hearings will be held in the East Wing of the Madison Building. April 2, 2008 - 11 AM: Time Warner Entertainment Co., L.P. v. Fleet Wholesale Supply Co., Inc., Opposition No. 91155422 [Section 2(a), 2(d), and dilution-based opposition to registration of the mark ROAD RUNNER for batteries, based upon Opposer Time Warner's ownership of the allegedly famous mark ROAD RUNNER for a variety of goods and services, including battery-operated toys and games].


April 9, 2008 - 2 PM: Wyeth v. Walgreen Co., Opposition No. 91165912 [Section 2(d) opposition to registration of the mark WAL-VERT for antihistamines and allergy relief preparations, in view of Opposer's registered mark ALAVERT for allergy relief and antihistamine preparations].


April 10, 2008 - 2 M: In re Sagoma Plastics, Inc., Serial No. 76576594 [Appeal from PTO rejection of Applicant's specimen of use for the mark DIGITALBOOK for binders and binding systems for holding digital media, on the ground that the specimen constitutes mere advertising and does not include the requisite ordering information].

April 16, 2008 - 11 AM: In re Luis, Serial No. 78688077 [Section 2(d) refusal of the mark VINFINITY for “electric vacuum pumps for the preservation of wine for commercial use” and “wine preservation system comprised of electric vacuum pumps, bottle seals and bottle stoppers for commercial use,” in view of the registered mark VINFINITI for "wine"].
