The Franklin Pierce Center for Intellectual Property at the University of New Hampshire Franklin Pierce School of Law invites you for its upcoming trademark law symposium, "Section Two Small: Exploring the New Constitutional Limits on Trademark Law" on Friday, November 3, 2023.The event will consist of panels on topics expected to include the threat of further constitutional challenges to Section 2, the Lanham Act’s core provision on trademark registration, expressive use of trademarks in the wake of Jack Daniels v. Looks like an interesting program with a diverse cast of characters. Thanks for letting us know. I signed up for the Zoom option.
Tam and Brunetti: Trademarks are expression! You can’t refuse to put people’s expression on your “list” of registered “expression” because you don’t like their expression! The First Amendment requires that a person’s expression, no matter what it is, be registered. That way, no one else can express that thought . . . . Wait . . . .
Jack Daniels: A cute squeaky dog toy with funny sayings on it isn’t expressive, so feel free to use your “expressive” trademark to stop the toymaker from poking fun at you.
