TTABlog Podcast: Trademark Fraud – The Impact of In re Bose on Trademark Owners, Practitioners, and the USPTO

My colleague and friend, Peter Lando, invited me as a guest on his Legal Talk Network program called IP Counsel, to discuss the Bose decision and some of its ramifications. [One thing we proved is that I have a voice for blogging.] Anyway, the podcast may be found here. Happy New Year!

You have a knack for coming up with interesting new words such as "fraudit" as you did in this podcast.

A question.

You mentioned a case before the TTAB dealing with a defense of innocence against a fraud claim.

The company was only using the Mark on one or two of the goods out of thirty listed.

Which case was that? I'd like to take a look at it.

Thanks for the great podcast.

See May 24, 2010 posting of Meckatzer case. It was a procedural ruling concerning the proper pleading of a fraud claim.
