TTAB Posts September 2016 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled five (5) oral hearings for the month of September 2016. Except for the first-listed hearing, the hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. The TV WEEKLY refusal should be reversed. At first glance, the LUMIERE and CARS appeals look like WYHAs.

All will be affirmed/dismissed, including TV WEEKLY, which is a weekly publication about TV.

Anon at 9:53am: There's no question that the terms "TV" and "WEEKLY" are descriptive; rather, the question is whether the design element carries the mark. I think it pretty clearly does.
