TTAB Posts December 2010 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled six (6) oral hearings for the month of December, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. December 2, 2010 - 10 AM: The Chamber of Commerce of the United States of America v. United States Hispanic Chamber of Commerce, Cancellation No. 92045876 [Section 2(d) petition for cancellation of a registration for the mark shown below for "chamber of commerce services, namely promoting business by and among Hispanic businesses and corporate America while fostering procurement and economic development opportunities as well as commercial and financial relations by and among Hispanic businesses with the general business community," in view of the registered mark U.S. CHAMBER OF COMMERCE for "association services, namely promoting the interest [sic] of business men and women"].


December 7, 2010 - 11 AM: Inviro Medical Devices Ltd. v. DuoProSS Meditech Corporation, Cancellation No. 92046702 [Section 2(d) petition for cancellation of the mark shown immediately below for "safety syringe for medical use," on the ground of likelihood of confusion with the registered marks SNAP in standard character and stylized form, and SNAP SIMPLY SAFER, for medical syringes].


December 8, 2010 - 11 AM: In re Steve Cooke , Serial No. 77386710 [Section 2(d) refusal of the mark shown immediately below, for "magazines featuring editorial and information for dog owners and the businesses who serve them and their dogs, providing a quality, cost effective lifestyle publication for advertisers," on the ground of likelihood of confusion with the registered mark THE BARKER in Stylized form for "magazines published periodically concerning shar-pei dogs"].


December 9, 2010 - 11 AM: Juan Antonio de la Cruz Gonzalez v. The Youssef Mehanna and Susana de la Cruz Joint Venture , Cancellation No. 92048199 [An apparent "family dispute" involving a petition for cancellation of a registration for the mark KUZ for "hair care preparations, namely shampoos, conditioners and hair dyeing preparations" on the grounds of Section 2(d) likelihood of confusion, Section 2(a) false association, and fraud in view of Petitioner's alleged prior use of the identical mark for the identical goods].


December 9, 2010 - 2 PM: U.S. Department of the Interior, National Park Service, Hot Springs National Park v. Hot Springs Advertising & Promotion Commission, Cancellation No. 92049191 [Section 2(e)(2) petition for cancellation of a registration for the mark shown below for "creating advertising for publications or direct mail advertising; cooperative advertising and marketing; displaying advertisements for others; and dissemination of advertising for others" on the ground that the mark is primarily geographically descriptive].



December 16, 2010 - 2 PM: Hunt Control Systems, Inc. v. Koninklijke Philips Electronics N.V., Opposition No. 91173417 [Section 2(d) opposition to SENSE AND SIMPLICITY for "electrical light dimmers, electrical circuit boards, printed circuit boards, electrical circuits for electrical conduction, printed circuits, electrical controllers" and related products, in light of the mark SIMPLICITY for "electrical light dimmers and lighting control panels"].

Is there a way to determine who the hearing officers will be prior to the hearing itself?

In the past, I have called the TTAB about a week before the hearing, and they have been willing to provide me with the name of the judges who will be sitting on the panel.
