TTAB Posts June 2010 Hearing Schedule

The Trademark Trial and Appeal Board has scheduled five (5) hearings for the month of June, as listed below. The hearings will be held in the East Wing of the Madison Building, in Alexandria, Virginia. June 8, 2010 - 10 AM: In re Takano Co., Ltd., Serial No. 77412149 [Section 2(d) refusal to register HeartWorks for “apparatus for measuring blood pressure, body fat, weight and pulse, namely, body and health monitoring machine for standard measurements, namely, weight, body mass index, body fat content, heart rate and blood pressure, to be operated by an individual in public indoor locations” and “wheelchairs; convertible wheel chairs” in view of the registered mark HEARTWORKS for "Medical equipment, namely, diagnostic workstations in the field of cardiology diagnostics, comprised of computer hardware and monitors, associated graphical user interface, and instruction manual sold in conjunction therewith"].


June 22, 2010 - 11 AM: In re Nick Bovis , Serial No. 77502609 [Section 2(e)(4) refusal to register the mark BOVIS FOODS for "wholesale distributorship services featuring food products" on the ground that the mark is primarily merely a surname].

June 22, 2010 - 2 PM: In re Roc USA, LLC , Serial No. 77044525 [refusal to register the mark ROC USA for business management consulting services and for educational services in the field of community development, on the ground of geographical descriptiveness under Section 2(e)(2)].


June 24, 2010 - 2 PM: Long & Foster Companies, Inc. v. LFC Corporate Services, Inc., Opposition No. 91181109 [Section 2(d) opposition to LFC, LFC.COM, and LFC ONLINE for various real estate services, in view of several LF marks for real estate services].


June 29, 2010 - 11 AM: In re Carl Walther GmbH, Serial No. 77096523 [Sections 1, 2 and 45 refusal to register the product configuration shown below for "Firearms; pistols; air pistols; and air soft guns" on the ground that the mark is non-distinctive and will not be recognized as a source identifier].
