CAFC Hears Oral Argument in Appeal From "STOP THE ISLAMISATION OF AMERICA" Disparagement Refusal
The CAFC heard oral argument [mp3 here] on Tuesday in the appeal from the Board's affirmance of a Section 2(a) refusal to register the mark STOP THE ISLAMISATION OF AMERICA for "providing information regarding understanding and preventing terrorism." The Board found the mark to be disparaging to a substantial composite of Muslims in the United States. In re Pamela Geller, Serial No. 77940879 (February 7, 2013) [not precedential].
